Keeping your home when someone dies

What happens to a tenancy or mortgage after a death.

When someone you lived with dies, worry about the home often follows grief.

Questions to ask

  • Whose name is on the tenancy, mortgage or deeds?
  • Was there a will?
  • Can the tenancy be passed to you?
  • How will rent or mortgage payments be made?

Steps

  • Tell the landlord or lender as soon as you can
  • Ask about succession rights
  • Get advice from a housing service or lawyer
